This article focuses on the location of the duty of loyalty—a unique legal norm in Common Law jurisdictions—both actual and desirable, on the continuum between rules and standards. A rule is a relatively ‘closed’ technical norm, at a high level of specificity; it requires little judicial discretion. A standard is an ‘open’ norm, with a greater degree of flexibility, that requires the exercise of discretion. The insights from this jurisprudential perspective are used to reveal the preferred way for further developing (...) the duty of loyalty. The article explains that ‘loyalty,’ intuitively classified as a ‘pure’ standard, has been reconstructed over time as more specific rules. Moreover, it suggests that, ideally, this movement should continue; namely, when applying loyalty to a specific case, courts should include informative content that would promote predictability. It then illustrates that, unfortunately, this road is not always taken by the courts. A decision to retain loyalty as an ad hoc standard, or an inverse attempt to delineate the boundaries of this norm, has implications on the certainty, consistency, and ethical content of the law. Considering that this duty spreads across different legal fields, personal and commercial, the significance of this discussion becomes all the more evident. (shrink)

The Drosophila tracheal system is a branched tubular structure that supplies air to target tissues. The elaborate tracheal morphology is shaped by two linked inductive processes, one involving the choice of cell fates, and the other a guided cell migration. We will describe the molecular basis for these processes, and the allocation of cell fate decisions to four temporal hierarchies. First, tracheal placodes are specified within the embryonic ectoderm. Subsequently, branch fates are allocated within the tracheal placodes, prior to migration. (...) Localized presentation of the FGF ligand, Branchless, to tracheal cells that express the FGF receptor, Breathless, guides migration. Once cell migration is initiated, distinct cell fates are determined within each migrating branch. Finally, inhibitory feedback mechanisms ensure the correct assignment of these fates. Tracheal cell fate choices are determined by signaling cascades triggered by signals emanating from the tracheal cells, as well as by ligands produced by adjacent tissues. Scaling of pattern with size has been described and studied for over a century, yet its molecular basis is understood in only a few cases. In a recent, elegant study, Inomata and colleagues proposed a new model explaining how bone morphogenic protein (BMP) activity gradient scales with embryo size in the early Xenopus laevis embryo. We discuss their results in conjunction with an alternative model we proposed previously. The expansion‐repression mechanism (ExR) provides a conceptual framework unifying both mechanisms. Results of (...) Inomata and colleagues implicate the chordin‐stabilizing protein sizzled as the expander molecule enabling scaling, while we attributed this role to the BMP ligand Admp. The two expanders may work in concert, as suggested by the mathematical model of Inomata et al. We discuss approaches for differentiating the contribution of sizzled and Admp to pattern scaling. The book Chronicle of Separation is an attempt to write on Derrida, to Derrida and from Derrida on the basis of a pathetic experience, which, in various ways, describes and enacts the pathetic experience of deconstruction itself. The book tackles the weight of emotions that is at the heart of deconstructive reading, treating deconstruction's weak, fragile and parasitic mode of thinking as a deconstruction of emotion, on emotion and as emotion. Chronicle of Separation examines these themes beginning with a descriptive (...) and an analytic reading of Derrida's Memoirs: For Paul de Man and The Post Card, as embodiments of deconstruction's melancholic friendship which inscribes its disillusioned love in what it calls the 'postal condition'. The book then moves on to a feminization of Derrida, experimenting in different modes of writing. It firstly discusses Fred Zinneman's film Julia about a mournful friendship between women. Then it performs a deconstructive meditation on the anorexic person suggesting that anorexia constitutes a paradoxical embodiment of deconstruction. The concluding chapter presents a complete incorporation of Derrida into a fictional text that re-writes the biblical Book of Ruth. (shrink)

The essay examines Scholem's letter-confession on the Hebrew language addressed to Rosenzweig from two perspectives hitherto ignored in the ongoing interpretative consideration of this document: Scholem's repression of the literary space and his consequent exclusion of madness. The essay follows several threads in Derrida's own ‘internal’ reading of the letter, and leans on other Derridean writings such as The Monolingualism of the Other, Schibboleth: For Paul Celan and ‘Cogito and the History of Madness’ in order to suggest two distinct encounters (...) between Derrida and Scholem: In the first encounter, Scholem reads Derrida and proves to be deconstructing his own notions of secular and profane Hebrew, while fighting in vain for his sanity by clinging to liturgical practices against the grain of an ongoing ‘actualization’, politicization or else fictionalization of the sacred language. In the second encounter, it is Derrida who reads Scholem. By transforming the particular conditions of possibility of Hebrew into general conditions of possibility of every language contaminated by a theological-political tension, Derrida contributes some important insights for contemporary Hebrew speakers. Previous studies have shown that children retreat from argument‐structure overgeneralization errors (e.g., *Don’t giggle me) by inferring that frequently encountered verbs are unlikely to be grammatical in unattested constructions, and by making use of syntax‐semantics correspondences (e.g., verbs denoting internally caused actions such as giggling cannot normally be used causatively). The present study tested a new account based on a unitary learning mechanism that combines both of these processes. Seventy‐two participants (ages 5–6, 9–10, and adults) rated overgeneralization errors with higher (...) (*The funny man’s joke giggled Bart) and lower (*The funny man giggled Bart) degrees of direct external causation. The errors with more‐direct causation were rated as less unacceptable than those with less‐direct causation. This finding is consistent with the new account, under which children acquire—in an incremental and probabilistic fashion—the meaning of particular constructions (e.g., transitive causative = direct external causation) and particular verbs, rejecting generalizations where the incompatibility between the two is too great. Recent works by feminist and social epistemologists have carefully mapped the contours of epistemic injustice, including gaslighting and prejudicial credibility deficits, prejudicial credibility excesses, willful hermeneutical ignorance, discursive injustices, contributory injustice, and epistemic exploitation. As we look at this burgeoning literature, attention has been concentrated mainly in four areas in descending order of emphasis: phenomena of epistemic injustice themselves, including the nature of wrongdoings involved, attendant consequences and repercussions, individual and structural changes for prevention or mitigation, and restorative, restitutive, or (...) retributive responses. This project urges greater attention to the last of these, and to that end offers a relational approach to epistemic justice drawing upon Margaret Walker’s work on moral repair and reparative justice. In developing and enacting better epistemic practices, how can such practices be made meaningfully restorative: not only recognizing the prospects for epistemic improvement, but responding to the perpetration and experience of epistemic injustice with effective epistemic amelioration? Power metaphysicians are concerned with, well, powers. Theists claim interest in the most powerful entity there is, God. As such, recent work on the ontology of powers may well have much to offer theists when thinking about God’s power. In this paper I start to provide a metaphysics of God’s ‘power’, something many definitions of omnipotence make reference to. In particular I will be interested in explicating how a power ontology can account for the strength and range of God’s power, (...) as well as showing how this account of divine power can fit with a timeless conception of God. If musical works are abstract objects, which cannot enter into causal relations, then how can we refer to musical works or know anything about them? Worse, how can any of our musical experiences be experiences of musical works? It would be nice to be able to sidestep these questions altogether. One way to do that would be to take musical works to be concrete objects. In this paper, we defend a theory according to which musical works are concrete objects. In (...) particular, the theory that we defend takes musical works to be fusions of performances. We defend this view from a series of objections, the first two of which are raised by Julian Dodd in a recent paper and the last of which is suggested by some comments of his in an earlier paper. Defenses of political obligation—the pro tanto obligation to obey the law because the state commands it—often operate at or near the level of ideal theory. Critics, though, increasingly question that approach’s relevance for the imperfect states that exist. This article develops a lesser evil framework to evaluate political obligation with several advantages over more ideal approaches: (1) avoids the questionable assumption that some actual states are reasonably just, (2) recognizes that context matters for political obligation, (3) captures the complicity involved (...) in obeying the state, and (4) identifies a basis—varying intuitions on lesser evil justifications—to distinguish philosophical anarchism from conceptions of political obligation without the former collapsing into the latter. We remain agnostic on whether this framework establishes political obligation to any state but argue that it offers a compelling account of the moral dilemma of obeying the state under nonideal conditions. This book argues for allyship masculinity as an open-ended, intersectional model for feminist men. It provides a roadmap for navigating between toxic masculinity on one side, and feminist androgyny on the other. Normative visions for what men should be take many forms. For some it is love and mindfulness; for others, wildness and heroic virtue. For still others the desire to separate a healthy manhood from toxic masculinity is a mistake: better to refuse to be men and salvage our humanity. (...) Though I challenge the visions that Mary Wollstonecraft, bell hooks, and others have offered, I share their belief that masculinity can be grounded in feminist values and practices. I argue that we can make sense of relational allyship as practices of feminist masculinity, such that men can make distinctive and constructive contributions to gender justice in the unjust meantime. Economics has become a monolithic science, variously described as formalistic and autistic with neoclassical orthodoxy reigning supreme. So argue Dimitris Milonakis and Ben Fine in this new major work of critical recollection. The authors show how economics was once rich, diverse, multidimensional and pluralistic, and unravel the processes that lead to orthodoxy’s current predicament. The book details how political economy became economics through the desocialisation and the dehistoricisation of the dismal science, accompanied by the separation of economics from the other (...) social sciences, especially economic history and sociology. It is argued that recent attempts from within economics to address the social and the historical have failed to acknowledge long standing debates amongst economists, historians and other social scientists. This has resulted in an impoverished historical and social content within mainstream economics. The book ranges over the shifting role of the historical and the social in economic theory, the shifting boundaries between the economic and the non-economic, all within a methodological context. Schools of thought and individuals, that have been neglected or marginalised, are treated in full, including classical political economy and Marx, the German and British historical schools, American institutionalism, Weber and Schumpeter and their programme of Socialökonomik, and the Austrian school. At the same time, developments within the mainstream tradition from marginalism through Marshall and Keynes to general equilibrium theory are also scrutinised, and the clashes between the various camps from the famous Methodenstreit to the fierce debates of the 1930s and beyond brought to the fore. The prime rationale underpinning this account drawn from the past is to put the case for political economy back on the agenda. This is done by treating economics as a social science once again, rather than as a positive science, as has been the inclination since the time of Jevons and Walras. It involves transcending the boundaries of the social sciences, but in a particular way that is in exactly the opposite direction now being taken by "economics imperialism". Drawing on the rich traditions of the past, the reintroduction and full incorporation of the social and the historical into the main corpus of political economy will be possible in the future. In particular, relative to a context C, ‘I’ refers to the agent of C. Since different contexts can have different agents, ‘I’ can refer to different objects relative to different contexts. In this paper, I argue against Millian Descriptivism: that is, the view that, although sentences that contain names express singular propositions, when they use those sentences speakers communicate descriptive propositions. More precisely, I argue that Millian Descriptivism fares no better (or worse) than Fregean Descriptivism: that is, the view that sentences express descriptive propositions. This is bad news for Millian Descriptivists who think that Fregean Descriptivism is dead.
